Agreement to these Terms By visiting, browsing or using the Site, sending us a form, or using our website chat assistant, you agree to these Terms and to our [Privacy Policy](https://royalgundogs.com/privacy-policy/). These Terms apply to the Site only. Any training, lesson or other service that Richard provides in person is arranged by phone and is a separate matter between you and Royal Gun Dogs. If you use the Site on behalf of someone else, you confirm that you have the authority to accept these Terms for that person. ## 2. Definitions In these Terms, the following terms have the meanings below. - "Site" means royalgundogs.com, including the plain-text versions of its pages, its summary files for search and AI tools, and any other page that links to these Terms. - "Content" means all text, photos, graphics, logos, videos, data and other material on the Site. - "Chat Assistant" means the website chat assistant named "Drake." - "Request" means any form submission, "before you go" panel submission, chat conversation in which you give your contact details, or email or text message in which you ask us a question or ask us to contact you. - "Training Services" means the gun dog training, lessons and related services that Richard Gebhart provides in person, arranged by phone. - "You" means any person who visits or uses the Site. ## 3. About us Royal Gun Dogs is a gun dog training business owned and run by Richard Gebhart. Richard trains retrievers and upland and pointing dogs, prepares dogs and handlers for AKC retriever hunt tests, and gives handler lessons. He has been training dogs since 2002. Richard trains at Hastings Island Hunting Preserve, 7758 Hastings Island Rd, Rio Vista, CA 94571, in Solano County, California. The preserve is a separate hunting club and is not a Royal Gun Dogs facility. Its rules, access and policies are its own. Eligibility You must be at least 18 years old, or be using the Site with the involvement of a parent or guardian, to send us a Request or use the Chat Assistant. By using the Site you confirm that you are able to form a binding agreement under the law that applies to you. ## 5. The Site is for general information only The Site provides general information about Royal Gun Dogs, gun dog training, dog breeds and related topics. It is not professional, legal, veterinary or other expert advice, and you should not rely on it as such. Information about breeds, training methods, hunt tests, hunting seasons and similar subjects is general and may be incomplete, may change, and may not fit your dog or your situation. Hunting seasons and regulations. Season dates, bag limits, licensing and other hunting rules come from the California Department of Fish and Wildlife (CDFW). Any such information on the Site is a convenience only. You are responsible for confirming current seasons and regulations at wildlife.ca.gov before you hunt or train, and CDFW's official publications control. Hunt tests. Hunt test rules, titles and requirements belong to the American Kennel Club (AKC), the Hunting Retriever Club (HRC) and the clubs that run the tests. Please check their current rules and entry information. Mention of a test or title on the Site does not guarantee that a dog will qualify, pass or earn it. No guarantee of results. Every dog and every handler is different. Training results depend on the dog, the owner or handler, the time and practice invested, and many other factors outside our control. Nothing on the Site promises or guarantees a particular result, title or outcome. ## 6. No booking or contract is formed by a web form Booking is by phone. Sending a form, using the "before you go" panel, chatting with the Chat Assistant or emailing us is a way to ask a question or ask Richard to call you. It does not book training, reserve a spot, create a contract or obligate either of us. A booking exists only when Richard confirms the details with you by phone. Prices, availability, schedules, location and what a program includes are confirmed by Richard directly, and any information on the Site about them is general and may change. ## 7. Your dog and your responsibilities If you arrange Training Services, you are responsible for providing accurate information about your dog, including its age, health, vaccination status and any history of behavior concerns, and for following Richard's reasonable directions. Dogs and hunting settings carry inherent risks, including injury to dogs and people. Richard will go over any program, requirements and expectations with you by phone. Any Training Services are subject to the arrangements you and Richard agree on directly, and to the rules of any property where training takes place, including Hastings Island Hunting Preserve. ## 8. The Chat Assistant Drake is an automated AI assistant, not a person. It is built and run by YelloPost AI, the Site's web provider, and answers general questions about Royal Gun Dogs and the information on the Site. Your messages are processed by YelloPost's AI service provider to generate replies. If you give your name and a telephone number or email address in the chat, those details are emailed to Royal Gun Dogs so that Richard can call you back, and a transcript of the chat is emailed to YelloPost for quality and support. Please do not enter sensitive information, such as payment card numbers, government identification numbers, passwords or health information. Replies are generated automatically and may be incomplete or wrong. The Chat Assistant cannot book training, confirm prices, dates or availability, or give professional advice, and nothing it says is a promise, offer or contract. Requests and contact When you send a Request, you agree to give accurate contact information and to send only information you have the right to share. We aim to respond to Requests promptly, but we do not promise a specific response time. Submissions If you send us comments, suggestions, photos or other material through the Site or otherwise, you confirm that you have the right to send it. You give us a non-exclusive, royalty-free permission to use it to respond to you, to operate and improve our business and the Site, and, only if you tell us we may, to show it publicly. Please do not send anything unlawful, confidential or that belongs to someone else. ## 11. Acceptable use You agree to use the Site only for lawful purposes and in a way that does not harm the Site or others. You agree not to: - Use the Site in violation of any law or regulation. - Send false, misleading or abusive Requests, or impersonate any person or organization. - Send spam, advertising or solicitations through our forms or the Chat Assistant. - Try to gain unauthorized access to the Site, its servers or any account, or to interfere with the Site's operation or security. - Bypass or disable the Site's protections, including Cloudflare Turnstile, the hidden spam field or rate limits. - Use bots, scrapers or automated tools to copy the Site at a rate or in a way that burdens it, or to submit forms. - Upload or transmit viruses or other harmful code. - Try to misuse the Chat Assistant, including attempting to make it reveal its instructions or behave in unintended ways. ## 12. Our intellectual property The Site and its Content, including the Royal Gun Dogs name, logo, photos, text, design and layout, are owned by Royal Gun Dogs or used with permission, and are protected by copyright, trademark and other laws. We grant you a limited, non-exclusive, revocable permission to view the Site and print or save pages for your personal, non-commercial use. You may not copy, modify, distribute, sell, republish or create derivative works from the Site or its Content, or use the Royal Gun Dogs name or logo, without our written permission. All rights not expressly granted are reserved. Names and marks of others, such as AKC, HRC, CDFW, Google, Facebook and Instagram, belong to their owners. ## 13. Copyright complaints We respect the rights of others. Third-party links and services The Site links to or relies on third-party websites and services, such as Google, Facebook, Instagram, the California Department of Fish and Wildlife, the American Kennel Club and others. Hastings Island Hunting Preserve is a separate club; we do not speak for it or control its policies. ## 15. Reviews and testimonials Reviews and testimonials on or linked from the Site reflect the opinions of the people who wrote them and their own experiences. They are not a promise that you will have the same experience or results. Because every dog and handler is different, results vary. ## 16. Availability and changes to the Site We work to keep the Site available, but we do not promise that it will be uninterrupted, error-free or free of harmful components. We may change, suspend or discontinue any part of the Site, its Content or its features at any time without notice. ## 17. Disclaimer of warranties The Site, its Content and the Chat Assistant are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent California law permits. This includes any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness and non-infringement. We do not warrant that the Site or its information is accurate, complete, current or suitable for your purposes, or that any training will produce a particular result. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you. ## 20. Limitation of liability To the fullest extent permitted by law, Royal Gun Dogs, Richard Gebhart and our service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of goodwill, arising out of or related to your use of or inability to use the Site, the Content or the Chat Assistant, or your reliance on information on the Site, even if we have been told such damages are possible. Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud or willful misconduct. Any Training Services are governed by the arrangements you and Richard agree on directly, and these Terms do not expand or reduce them. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. ## 21. Indemnification To the extent permitted by law, you agree to defend, indemnify and hold harmless Royal Gun Dogs, Richard Gebhart and our service providers from claims, losses, liabilities and reasonable expenses, including reasonable attorneys' fees, arising out of your violation of these Terms, your misuse of the Site, or your violation of the rights of another person. We will tell you promptly of any claim we ask you to cover, and we may take part in the defense at our own cost. ## 22. Most concerns can be resolved with a conversation. This step does not limit your right to go to court. ## 23. Governing law and venue These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any legal action will be brought in the state or federal courts with jurisdiction over Solano County, California, and you and we consent to the personal jurisdiction of those courts. ## 24. Assignment You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms, for example if Royal Gun Dogs is sold or reorganized. These Terms bind and benefit the parties and their permitted successors. ## 25. Severability If a court finds any part of these Terms unenforceable, that part will be enforced to the extent possible and the rest of the Terms will remain in effect. ## 26. No waiver If we do not enforce a right or provision of these Terms, that is not a waiver of it. A waiver is effective only if it is in writing and signed by us. ## 27. Entire agreement and interpretation These Terms, together with our [Privacy Policy](https://royalgundogs.com/privacy-policy/), are the entire agreement between you and Royal Gun Dogs about your use of the Site and replace earlier understandings about it. Headings are for convenience only. "Including" means "including without limitation." ## 28. Notices We may give you notice by posting on the Site, by email to an address you gave us, or by another reasonable method. Survival Provisions that by their nature should continue after you stop using the Site will continue, including those on intellectual property, disclaimers, limitation of liability, indemnification, governing law and venue. ## 30.
